Purposes of data collection
Rightsholders (publishers and authors) allow CLNZ to licence their materials to you and other licenceholders on the understanding that they will receive funds from us in exchange. For us to do this we need to ask licenceholders to provide us with data on their usage of copyright material under the licence each year.
Only a small set of licenceholders are asked to carry out data collection each year; it is very unusual for a licenceholder to be asked to carry out data collection more than once in a five-year period. We use a statistically relevant sample proportion of licenceholders to calculate usage across all licenceholders.
Consistent with our role as a licensing agency rather than an enforcement agency, CLNZ does not approach data collection as a compliance exercise, although licenceholders may choose to treat it as one. If you find during data collection that usage above the licence limits has occurred no penalty is imposed, although you will need to seek permission from the rightsholder for the excess usage, since the licence can’t be relied on beyond its stated limits.
